The focus of this paper is the narrower category of 'legal rights', and while much of Ross's work is similarly narrowly focused, some of Olivecrona's analysis could be seen as directed at 'rights' generally (that is, including moral rights as well). One of the interesting debates in the discourse on rights is whether right is an interest or a matter of choice or will. According to the choice theory, rights are recognised so as to protect the exercise of choice by the person who has the right. Lundstedt was a leading legal exponent of Hägerström's philosophy; yet in arguing for basing the law on "the needs and interests of society," he seemed to be making an argument that is inextricably normative and evaluative.
